Shipping terms


1. Definitions
1.1 "Baggage" refers to every object, including vehicles, that is transported for the passenger and is therefore not considered cargo.

1.2 "Hand baggage" refers to baggage that the passenger carries or has in his cabin or otherwise under his care during the transport, including items in or on his vehicle.

1.3 "Cargo" refers to goods that passengers cannot bring with them during transport or store in the car; goods in the ship’s cargo hold or in a vehicle with a weight in excess of 150 kilograms, which are being transported as part of commercial activities; and buses and similar vehicles in professional intercity or charter traffic for mass passenger transport.

2. Applicable law: Swedish law
2.1 With the following exception under 2.2, Swed-ish law applies to transports carried out by the Shipping Line according to these terms.

Foreign law and special regulations
2.2 In naval transport carried out by another carrier than the Shipping Line as defined in 5.5, foreign law may apply. Special regula-tions apply for transports with rail ferries on a through-ticket. Contact the railways for more information.

3. Seat reservations and binding agreements
3.1 Passenger and vehicle space for long-distance traffic must be reserved beforehand. Space on board cannot be guaranteed with-out reservations. Long-distance traffic refers to all traffic other than what is specified in 3.2.

3.2 We recommend reserving passenger and vehicle space even for short-distance travel for passengers who absolutely must travel with a specific route, since no guarantee of availability can otherwise be made for every instance. Short-distance travel refers to routes to Denmark, Gotland, Norway and Åland.

3.3 The passenger and the Shipping Line have a binding agreement when
a) reservations are confirmed by the Shipping Line; or, if reservations are not required, when
b) the ticket price is paid; or if no compensation is paid, when
c) the passenger commences boarding on a ship or other means of transport provided by the Shipping Line.

4. Ticket and ship
4.1 A ticket must be shown upon checking in prior to boarding. Arrangements such as package trips, bus travel, hotel stays, excursions and meals are only included in the ticket price if this is clearly specified.

4.2 The Shipping Line is entitled to provide transport with its regular intercity ships or other suitable vessels.

5. The Shipping Line’s responsibility
5.1 The Shipping Line is responsible for damages or loss due to events during transport or due to delays, if the damage or loss was caused by error or neglect on the part of the Shipping Line or any individual for which the company is responsible. Chapter 15 §20 of the Swedish Maritime Code states that the Shipping Line can only deny responsibility if it can prove that no error or neglect occurred. As regards responsibility for delays, the Shipping Line specifies that its published route lists are based on normal conditions. If the Shipping Line provides connecting transport with other means than ship, the Shipping Line is responsible for damages or losses according to the rules that apply for that means of transport.

5.2 Limits to the Shipping Line’s responsibility for damage, loss or delay. The limitations defined in 5.3 and the exemptions defined in 5.4 do not apply if it is proven that someone in the Shipping Line’s management caused the damage intentionally or through gross negligence.

5.3 The limiting amount is defined in the Inter-national Monetary Fund’s Special Drawing Rights (SDR). The value of SDR is listed in daily press under the heading Exchange Rates. The amounts for which the Shipping Line is liable are defined below in SDR:
1) personal injury and death, SDR 175,000
2) passenger delay, SDR 4,150
3) damage, loss or delay of:
a) hand baggage, not stored in or on a vehicle, SDR 1,800
b) valuables that the shipper received for safekeeping, SDR 6,750
c) vehicle or baggage stored in or on the vehicle, SDR 10,000
d) other baggage, SDR 2,700

Exemptions
5.4 The Shipping Line is exempted from all responsibility as regards:
a) passengers who have not yet boarded or have already disembarked, with the exception described in 5.1 above.
b) hand baggage before it is brought on board and after it is taken off the ship, with the exception described in 5.1 above.

The Shipping Line is not liable to reimburse the passenger for money, objects of art or other valuables unless the Shipping Line received the property for safekeeping.

5.5 These exceptions do not apply in cases defined in 5.2 above.

Exemption from responsibility for naval transport by parties other than the Shipping Line
5.6 If the ticket indicates or if it is otherwise agreed or clearly understood that all or a specific part of the transport will be carried out by a party other than the Shipping Line, the Shipping Line is not responsible for damage, loss or delay caused by events during the part of the trip provided by the other. The same applies if the passenger according to a valid agreement is entitled to use a carrier other than the Shipping Line for all or part of the transport.

Excess
5.7 The Shipping Line reserves the right to claim an excess of the passenger up to:
1) for each damaged vehicle, SDR 150
2) for each other baggage damage, SDR 20
3) for damage due to delays, SDR 20
The excesses do not apply in cases as defined in 5.2, nor in the case of total loss.

6. Cargo
Cargo is transported according to the regulations in Chapter 13 of the Swedish Maritime Code and in the Shipping Line’s shipping terms and ice clause. Shipping rates for cargo are defined by tariffs.

7. Dangerous goods, passenger’s liability for damages
Baggage that can cause danger or significant inconvenience for the ship, lives or other goods may not be brought on board as baggage or hand baggage. It must be registered as cargo and transported according to special regulations. According to Chapter 15, §8 of the Swedish Maritime Code, the passenger is required to inform the Shipping Line of the dangerous nature of the baggage before departure. According to the circumstances, the Shipping Line is entitled to have dangerous baggage taken off the ship, neutralised or destroyed if it was brought aboard without the Shipping Line being informed of its nature, without reimbursing the owner. If baggage causes damages to the Shipping Line or the ship, the passenger is liable to pay if the damages are the result of error or neglect on the part of the passenger or someone for whom the passenger is responsible.

8. Deviations from timetables
The departure and arrival times listed in the timetables are recommendations only and are not to be considered guarantees. Deviations from the timetable may occur in connection with military transports, ship repairs, delays or changed routes as a result of weather and wind conditions, and as a result of conditions over which the Shipping Line has no control.

9. Claims
Any complaints must be immediately brought to the attention of the ship’s command. Requests for damages must be submitted to the Shipping Line within reasonable time after the damage or loss.

10. Limitations
The following claims will not be considered unless action is taken in an appropriate court:
1) claims for remuneration for personal injury or delay.
alt a) within two years after disembarking or
alt b) if the passenger died during transport, within two years of the day of intended disembarkation, or
alt c) if the passenger died after disembark-ing, within two years of death, but no more than three years after disembarking.

2) claims for remuneration for baggage that was damaged, lost or delayed during naval transport.
alt a) within two years after the goods were unloaded or
alt b) if lost, within two years after the goods would have been unloaded.

11. Other terms
Otherwise, the special terms defined in the route list for Destination Gotland apply. These terms are located at all sales locations in the terminals and can be requested from the Shipping Line.
